With the help of as much detailed data as possible, companies can trace the consumption behavior of individuals very precisely and, for example, design and implement their advertising strategies in a targeted manner. They can draw entire personality profiles of individuals, i.e. they can find out what kind of car someone drives, what kind of books they read, what kind of music they listen to, how much they spend on clothes, housing, insurance or vacations, what destinations they prefer, and so on. In this way, consumers can be divided into target groups according to certain criteria. In addition, companies can find out whether a customer is a good or bad payer. All this happens, mind you, for the most part without most people having the slightest idea about it. Of course, this can lead to questionable incidents or even abuses, without anyone being able to do anything about it because they are clueless. Personal data is therefore a valuable asset not only in material terms, but also in ideal terms, because in a democratic society based on the rule of law, it is unacceptable that people no longer have even minimal control over the use of data that concerns them. The so-called right to informational self-determination is an important principle of our social order. This means that every person should be able to decide for themselves as far as possible what information about them is disclosed, when, where and to whom. This does not only apply to the economic side; state and health institutions are also interested in personal data - think, for example, of the war against international terrorism or against organized crime, but also of efforts to reduce health care costs. Put simply, one could say that the first goal of data protection must be to defend people's right to informational self-determination. This task is not always easy, since in some cases there may also be legitimate interests that restrict this right to self-determination, for example in the case of police investigations. Data protection should ensure that proportionality is observed in every case, i.e. that only as much personal data as necessary and as little personal data as necessary is collected and processed, and that the data subject also has the opportunity to control and, if necessary, prevent the processing of data about him or her as far as possible. Therefore, it is indispensable that the data subject has the possibility to obtain an account from the owners of data collections about which data about him or her is being processed. For this purpose, the Data Protection Act stipulates a right to information that can be asserted against the owners of data collections.

8.1 How and where is data protection defined in the law?

Article 13 of the Swiss Federal Constitution lays down the fundamental right of every person to respect for his or her private and family life, his or her home, and his or her correspondence, post and telecommunications, and to protection against misuse of his or her personal data.

To anchor this protection in law, the Federal Data Protection Act (DPA) was passed and has been in force since July 1, 1993. The corresponding ordinance (VDSG) regulates the details.

In addition, there are numerous provisions for the protection of personality in other laws and areas. Articles 28-28l of the Civil Code (CC) specify how legal action is taken in the event of violations of personality rights.

We will retain your personal data for the period necessary for the purposes set out in this Privacy Policy, in particular to fulfill our contractual and legal obligations. We may also retain your personal data for other purposes if the law allows us to retain your personal data for a specific purpose, including the defense of legal claims. If you close your customer account, we will delete all data stored about you. If a complete deletion of your data is not possible or necessary for legal reasons, the relevant data will be blocked for further processing.

What does locking mean? When data is locked, access rights are restricted and other technical and organizational measures are taken to ensure that only a limited number of employees have access to the relevant data. These employees may then only use the blocked data for previously defined purposes (e.g., for tax office audits).

Blocking occurs, for example, when:

  • Your order and payment data as well as other data are generally subject to various statutory retention obligations. We are required by law to retain this data for tax audits and audits for up to ten years. Only then can we finally delete the relevant data.
  • Even if your data is not subject to any legal retention obligations, we may, to the extent permitted by law, waive immediate deletion and instead block it first. This applies in particular in cases where we may still need the data in question for further contract processing or for legal prosecution or defense (e.g. in the event of a complaint). The statutory period of limitation shall be decisive for the duration of the blocking. After expiry of the respective limitation period, the relevant data will be permanently deleted.

Deletion of anonymized or pseudonymous data may be avoided to the extent permitted by law and deletion would render impossible or seriously impair their processing for scientific research or statistical purposes.

We use encryption technology to transfer your personal data securely. This applies to your orders, but also to customer logins. We use an SSL encryption system (Secure Sockets Layer). In addition, we secure our website and other systems through technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons.
